TL;DR

Gena VPN gives you encrypted access to the internet through our servers. Use it for lawful purposes only. If you buy a subscription, Apple or Google handles the payment and the auto-renewal — refunds for those go through them. We provide the service "as is" and our liability is limited. Disputes are governed by Armenian law.

1. About these Terms

These Terms of Service ("Terms") form a binding agreement between you and Samvel Vardanyan, a sole proprietor based in the Republic of Armenia, regarding your use of the Gena VPN mobile applications and related services ("Gena VPN", "the Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Service.

2. The Service

Gena VPN is a virtual private network application for iOS and Android. It encrypts your traffic and routes it through our servers. We do not guarantee any specific level of speed, latency, geographic availability, or uninterrupted service. Throughput depends on your network, the load on our servers, and conditions outside our control.

3. Eligibility

You must be at least 13 years old to use Gena VPN, or older where required by your local law. By using the Service, you represent that you meet this requirement.

You are responsible for complying with the laws of the country you are in. VPN use is restricted or illegal in some jurisdictions. If using a VPN is unlawful where you are, you must not use Gena VPN.

4. Your account

• You must provide a valid email address and a secure password.
• You are responsible for keeping your credentials secret and for any activity on your account.
• Notify us at genavpndev@gmail.com immediately if you suspect unauthorised access.
• One person, one account. Do not share your account.

5. Acceptable use

You agree to use Gena VPN only for lawful purposes. You must not, and must not allow anyone using your account to:

• Distribute malware, ransomware, viruses, or other harmful code.
• Engage in or distribute child sexual abuse material or other content prohibited by law.
• Attempt unauthorised access to networks, systems, or accounts.
• Send unsolicited bulk email (spam) or conduct mass scanning.
• Infringe copyright, trademarks, or other intellectual property rights.
• Conduct denial-of-service attacks.
• Harass, threaten, defraud, or impersonate others.
• Use the Service to violate the export-control or sanctions laws of any jurisdiction that applies to you.

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms. We may cooperate with law enforcement when required by law.

6. Subscriptions

Gena VPN offers paid subscriptions purchased through Apple's App Store or Google Play. The price, period (monthly / yearly), and any free-trial terms are shown in the app before purchase.

6.1 iOS — Apple In-App Purchase

• Payment: charged to the Apple ID associated with your device at confirmation of purchase.
• Auto-renewal: the subscription automatically renews for the same period at the same price unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Renewal charge: Apple charges your account for renewal within 24 hours before the end of the current period.
• Managing the subscription: you can manage and turn off auto-renewal in your iOS device's Settings → [Apple ID] → Subscriptions at any time after purchase.
• Free trial (if offered): any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

6.2 Android — Google Play Billing

• Payment: charged to your Google account on confirmation of purchase.
• Auto-renewal: the subscription automatically renews for the same period at the same price unless you cancel at least 24 hours before the end of the current period.
• Managing the subscription: you can manage or cancel from the Google Play Store under Subscriptions.

6.3 Promotional codes and trials

If we offer promotional codes or trials, the specific terms (duration, eligibility, restrictions) are shown when the offer is presented. Promotions are non-transferable and have no cash value.

7. Refunds

• Apple App Store purchases: refund requests for in-app purchases must be submitted to Apple at reportaproblem.apple.com. We are not able to issue refunds for App Store purchases — Apple handles them according to its own refund policy.
• Google Play purchases: refund requests must be submitted to Google through Google Play Help.
• Direct refunds: in the rare cases where you paid us directly (not through Apple or Google), we will consider refund requests on a case-by-case basis. If we terminate your subscription early for reasons other than your breach, we will refund the unused portion pro rata.

8. Termination

You may stop using Gena VPN at any time by uninstalling the app and / or deleting your account from the app. Cancelling auto-renewal in the App Store or Play Store stops future charges; access continues until the end of the period you already paid for.

We may terminate or suspend your account if you breach these Terms, if continued provision becomes unlawful, or if we wind down the Service. If we wind down the Service entirely, we will give reasonable notice and refund the unused portion of your current subscription period, less any amounts not refundable to us by Apple or Google.

9. Disclaimer of warranties

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.

We do not warrant that the Service will be free of errors, secure against every threat, or available in every location at every time.

10. Limitation of liability

To the maximum extent permitted by law, in no event will we, our affiliates, or our suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, our liability is limited to the smallest amount permitted by law.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your violation of any third party's rights through use of the Service.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to the Service or these Terms will be brought in the competent courts of the Republic of Armenia, and you consent to the personal jurisdiction of those courts.

If you reside in a jurisdiction where mandatory consumer-protection law gives you broader rights, those rights are not affected by this section.

13. Acknowledgement regarding Apple (iOS only)

These Terms are between you and Samvel Vardanyan, not Apple Inc. Apple is not responsible for the Service or its content. To the extent these Terms differ from Apple's Apple Media Services Terms and Conditions or its standard licence terms, Apple's terms govern your use of the iOS application as it relates to Apple's role. You also agree that:

• Apple has no obligation to provide maintenance or support for Gena VPN.
• In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the application to you (where applicable). Apple has no other warranty obligation whatsoever with respect to the Service.
• We, not Apple, are responsible for addressing any claims relating to the Service or your use of it (including product-liability claims, claims that the Service fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation).
• We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the Service.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify you at least 30 days before it takes effect, by email or via an in-app notice. Continued use of Gena VPN after a change takes effect means you accept the updated Terms.

15. Miscellaneous

• Entire agreement. These Terms together with the Privacy Policy and any in-app additional terms constitute the entire agreement between you and us regarding the Service.
• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
• No agency. Nothing in these Terms creates a partnership, agency, or employment relationship.
